Evidence Rule 102 -- Purpose and Construction
State v. Boston (1989), 46 Ohio St. 3d 108, 116 -- Ohio Evidence Rule 102 admonishes the courts of Ohio to construe the Rules of Evidence in a manner consistent with the common law unless the rule clearly indicates a change is intended. This varies from the Federal Rules and those of other states which are to be construed broadly to promote the growth and development of the law of evidence. Also see State v.
