INTRODUCTION

This volume and CD update the Criminal Law Casebook, Second Edition, published in 2000 by the Franklin County Public Defender and the Ohio Association of Criminal Defense Lawyers. The 2005 update may be discarded. The text is current through 110 Ohio St. 3d 352, 167 Ohio App. 3d 40, 137 Ohio Misc. 2d 19, and 126 S.Ct. 2986.

New topics this year are Community Service and Innocence. Following the decision of State v. Foster abrogating the findings requirements of Senate Bill II sentencing, the sentencing chapter has been shortened and realigned under new subheadings. Homicide has also been reorganized.

The text of the main volume continues to be updated, to correct minor errors and to add recent cases cumulative to those already covered. Cases addressing issues which merit a new entry appear both the print and CD versions of the 2006 update. Access to the updated version of the main text is limited to the CD.

The CD includes the texts in Word Perfect 5.1, in which they were prepared, and translated to Microsoft Word. The three digit numbers which appear in the table of contents and index identify the individual files on disk. The prefix ME indicates the original text and MES the update.

The use of dashes (--) in place of a page number in the table of contents and index indicates no additional annotations since publication of the main volume.
